Wtta: what the admission system means for hirers

With the Wtta, the Wet toelating terbeschikkingstelling arbeidskrachten (Placement of Workers Admission Act), compulsory admission is coming for everyone who hires out workers. This affects not only staffing agencies, but also you as a hirer. In this article you can read what the admission system involves, which requirements apply and what you need to look out for as a client.

Meeting about laws and regulations for hiring in staffLAWS AND REGULATIONS

Why the Wtta is coming

The staffing market is large and for years it was easy to enter. As a result, parties that did not follow the rules could also become active, leading to underpayment, poor housing and tax evasion. Reputable agencies and their clients suffered from this.

The Wtta is meant to put an end to this. Anyone who makes workers available will soon need admission. Without admission you may not hire out workers, and hirers may only hire staff from admitted agencies.

Requirements for admission

To obtain admission, an agency must meet a number of conditions. Directors and other persons involved must be able to produce a Certificate of Conduct (VOG). In addition, the agency must deposit a guarantee of 100,000 euros as financial security. For start-up agencies a phased deposit applies: a lower amount at the start and the rest after six months.

The agency must also demonstrate that it complies with the applicable rules. For this there will be periodic inspections based on a set of standards. These cover, among other things, payment of taxes and contributions, paying the correct wage, identity checks and compliance with the rules on employment and housing.

Admission is not a one-off stamp. Anyone who fails to meet the standards at an inspection can lose their admission again.

What the Wtta means for hirers

For hirers, the most important change is that you have to check yourself whether an agency has been admitted. There will be a public register in which you can check this. If you hire staff from an agency without admission, you risk a fine. That fine can be imposed per hired worker.

This means you have to check the admission before a collaboration starts, and periodically afterwards, because admission can also be withdrawn. Record that check in your file, just as you already do with the statement of payment history. In the article on hirer's liability and the G-account you can read which other documents to keep.

Also note that the Wtta is not only about traditional staffing agencies. Other forms of making workers available are also covered. If you are unsure whether an arrangement falls under the act, seek advice.

In practical terms, it is sensible to draw up a list now of all the parties you hire staff from, including small or occasional suppliers. That way you will know exactly whom to check and can take action in time if a party does not apply for admission.

Start date and transition period

The introduction of the Wtta has been postponed several times. The act comes into force on 1 January 2027; from then on, agencies can apply for admission. The licensing requirement itself applies from 1 January 2028. From that date, hirers may only hire workers from an admitted agency.

Because dates and details may still change, we advise you to check the current situation with the Dutch government (Rijksoverheid). Do not make decisions based on a date from an older article.

PREPARING AS A HIRER
Do you know which agencies you currently hire staff from?
Have you included checking admission in your planning?
Who in your organisation checks the register, and how often?

How Work4you! is preparing for the Wtta

Work4you! was founded in 2026 and has been set up for the Wtta from the start. This means we have organised our administration, wage payments and checks so that they align with the expected set of standards. We are a member of the NBBU and follow the NBBU cao.

We work with a G-account and provide a statement of payment history every quarter. SNA certification (NEN 4400-1) and SNF certification for housing have been applied for. As soon as it is possible, we will apply for admission under the Wtta and keep our clients informed of the status.

If you want to know what that looks like in practice, take a look at the page for clients or read more about us.
